The common law is ...This seems a positive decision. The common law is based inductively on a myriad individual decisions, each taken in good faith and each given to the best of the court's ability. The idea that a court would decide that its decision is non-precedential, let alone withdraw a prior decision, seems bizarre and arguably an arrogation of the legislative function. The only basis on which a court can sensibly decide that its decision is non-precedential is if, on application made in accordance with the rules, it holds that its prior decision was wrong.Anonymousnoreply@blogger.com
